These Terms govern your access to and use of all content, products, and services available at https://trackhawkgps.com (the “Service”) operated by Trackhawk LLC (“us”, “we”, or “our”).
By accessing or using the Service, you agree to be bound by these Terms without modification. If you do not agree to any part of the Terms, you may not access or use the Service.
The Agreement does not transfer from us to you any of our or third-party intellectual property. All right, title, and interest in and to such property will remain (as between the parties) solely with Trackhawk LLC and its licensors.
In using the Service, you may use third-party services, products, software, embeds, or applications developed by a third party (“Third-Party Services”).
By using Third-Party Services, you understand and agree that:
Any use of a Third-Party Service is at your own risk, and we shall not be responsible or liable for them.
We are not responsible or liable for any damage or loss caused or alleged to be caused by or in connection with the use of, or reliance on, any such content, goods, or services available through any such websites or services.
Where use of any part of our Service requires an account, you agree to:
Provide complete and accurate information when registering.
Be solely responsible for all activity under your account.
Keep your account information current and your password secure.
You must not share or misuse your access credentials. You must notify us immediately at support@trackhawkgps.com if you suspect any unauthorized use of your account or other security breach.
Our Service may contain links to third-party websites or services not owned or controlled by Trackhawk LLC.
We are not responsible for the content, privacy policies, or practices of third-party websites or services. You acknowledge and agree that Trackhawk LLC shall not be liable for any damage or loss caused or alleged to be caused by reliance on or use of any such content, goods, or services.
We encourage you to review the terms and privacy policies of any third-party websites you visit.
Certain parts of the Service may be billed on a subscription basis (“Subscriptions”). You will be billed in advance on a recurring and periodic basis (“Billing Cycle”), depending on the plan you select.
Auto-Renewal: Unless you cancel your Subscription before the end of the Billing Cycle, it will automatically renew under the same terms.
Cancellation: You may cancel your Subscription at any time by contacting support@trackhawkgps.com. Cancellation will take effect at the end of the current Billing Cycle.
Refunds: Except as required by law, prepaid fees are non-refundable. Hardware purchases may be subject to additional return policies provided at the time of sale.
Trials: If you are offered a free trial, you may be required to enter billing information. At the end of the trial, unless you cancel, you authorize us to charge for the Subscription.
If your subscription is cancelled due to non-payment, the following reactivation terms apply:
First Missed Payment
The first reactivation following a missed payment will be provided at no charge.
Subsequent Missed Payments
If a payment is missed again and your account is cancelled, a reactivation fee of $22 will be assessed.
Cancellation Exceeding Three (3) Months
If your account remains cancelled for a period of three (3) months, a reactivation fee of $69 per unit will be required.
Cancellation Exceeding Twelve (12) Months
If your account remains cancelled for a period of twelve (12) months, the subscription will be deemed permanently terminated. To resume service, you must pay a reactivation fee of $69 per unit and purchase a new SIM card ($20 per SIM) for each device, which must be physically replaced to restore connectivity.
You agree not to misuse the Service or assist anyone else in doing so. Misuse includes, but is not limited to:
Using the Service for any unlawful purpose, including tracking individuals without consent where required by law.
Attempting to gain unauthorized access to the Service, systems, or networks.
Reverse engineering, decompiling, or attempting to derive the source code of any software provided.
Reselling, sublicensing, or otherwise providing the Service to third parties without our prior written consent.
Trackhawk LLC is not responsible for any issues, damages, or losses arising from the installation or use of our hardware devices in vehicles or equipment. You acknowledge and agree that:
Installation of devices should only be performed by qualified professionals, and you assume all risks related to installation.
We do not guarantee compatibility of any device with your specific vehicle, equipment, or electrical system.
Trackhawk LLC shall not be liable for any damage to vehicles, equipment, electrical systems, or related components resulting from installation, improper wiring, removal, or operation of our devices.
You are solely responsible for ensuring that use of the devices complies with all applicable local, state, and federal laws, including but not limited to vehicle tracking, driver consent, and privacy regulations.
Any instructions, guides, or recommendations provided by Trackhawk LLC are for informational purposes only and do not replace professional installation or advice.
By using our hardware devices, you accept full responsibility for installation, operation, and all related outcomes.
Trackhawk LLC shall not be responsible for any damages, losses, or claims arising from the inability to start, stop, or operate a vehicle due to device configuration, activation, deactivation, or any verification requirements imposed by us.
Device Control & Verification
You acknowledge and agree that Trackhawk LLC may require proof of identity and/or ownership prior to enabling, disabling, or otherwise controlling any device functionality (including but not limited to remote immobilization or vehicle start permissions). In the absence of sufficient verification, Trackhawk LLC shall be under no obligation to act on such requests and shall bear no liability for any resulting inability to operate or access a vehicle. Trackhawk LLC is not an emergency service provider and shall not be relied upon for urgent safety or medical situations.
You may not use, export, re-export, or transfer any portion of the Service or hardware except as authorized by U.S. law, the laws of the jurisdiction in which you obtained the Service, and any other applicable laws. In particular, you may not export or re-export to:
Any U.S. embargoed countries; or
Any person or entity on the U.S. Treasury Department’s list of Specially Designated Nationals or the U.S. Department of Commerce Denied Person’s List.
By using the Service, you represent and warrant that you are not located in any such country or on any such list.
You retain all rights to data that you input or generate through the Service (“Customer Data”). Trackhawk LLC does not claim ownership of Customer Data.
You grant us a non-exclusive, worldwide, royalty-free license to host, use, process, transmit, and display Customer Data only as necessary to provide the Service and improve our offerings. We may use aggregated and anonymized data that does not identify you for analytics, benchmarking, and product improvement.
Our use and processing of personal data is further described in our Privacy Policy, which is incorporated into these Terms by reference.
We may suspend or terminate your access to all or part of the Service at any time, with or without cause, and with or without notice, effective immediately.
If you wish to terminate your account, you may simply stop using the Service. Formal termination requests must be submitted by the Trackhawk GPS account owner using their registered email by contacting support@trackhawkgps.com.
All provisions of these Terms which by nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
The Service is provided on an “AS IS” and “AS AVAILABLE” basis. Trackhawk LLC and its suppliers and licensors disclaim all warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We make no warranty that the Service will be error-free or that access will be continuous or uninterrupted. You understand that you download or obtain content or services through the Service at your own discretion and risk.
To the maximum extent permitted by law, in no event shall Trackhawk LLC, its affiliates, suppliers, or licensors be liable for:
Any indirect, incidental, special, consequential or punitive damages; or
Any loss of profits, revenues, goodwill, data, or other intangible losses,
arising out of or related to your use of the Service, regardless of the theory of liability (contract, tort, or otherwise), even if we have been advised of the possibility of such damages.
Our total liability for any claims arising under these Terms shall not exceed the greater of (a) the amounts you paid to Trackhawk LLC for the Service in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100).
You agree to indemnify, defend, and hold harmless Trackhawk LLC, its affiliates, contractors, licensors, and their respective directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney’s fees) arising out of or in connection with:
Your use of the Service;
Your violation of these Terms; or
Your violation of any third-party rights, including intellectual property or privacy rights.
Trackhawk LLC shall not be held liable or responsible for any failure or delay in performance caused by events outside of our reasonable control, including but not limited to acts of God, natural disasters, government actions, labor disputes, power failures, internet or communication outages, or equipment failures.
If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Unless otherwise required by law, these Terms and any disputes arising out of or related to them will be governed by the laws of the State of Texas, without regard to conflict-of-law principles.
The exclusive venue for any legal action shall be the state and federal courts located in Texas.
These Terms constitute the entire agreement between you and Trackhawk LLC concerning the Service and supersede and replace any prior agreements, written or oral, regarding the Service.
Trackhawk LLC reserves the right, at our sole discretion, to modify or replace these Terms at any time.
If changes are material, we will provide notice by posting on our website or by email before the changes take effect. We will provide at least 30 days’ notice where possible.
If you disagree with the new Terms, you should stop using the Service within the notice period. Continued use of the Service after the effective date constitutes acceptance of the new Terms.
